OJSC "Turboatom" keeps nature conservation legislation of Ukraine

On the 12th of February 2010 Economic court of Kharkov region refused in satisfying claim of the Government Ecological Inspection Kharkov Region to OJSC "Turboatom" regarding abuse of nature conservation legislation of Ukraine by the enterprise.

With conformed claim the ecological government inspection went to the law on the 11^th of November 2009. The cause of trials was the check-up, on which results were fixed the fact of the ground area pollution of OJSC "Turboatom" by construction waste (debris). The act was formed by the officials of the government inspection and the sum of the fine was appraised at the rate of 37 Thousand hryvnas.

Though OJSC "Turboatom" didn’t agree with indicated conclusions, according to what on the 11^th of November 2009 the conformed claim was declared by the government inspection to Economic Court of Kharkov Region.

The decision of the court was determined that OJSC "Turboatom" legally implements waste building disposals on the base of allowance, issued by the Government Natural Environment Protection in Kharkov Region on 2009.

Having declared, the inspection didn’t produce proofs of exceeding by the enterprise conformed limits to the court. Besides, neither in the act of check-up, nor in statement of claim and applications to it didn’t specified in what way wastes pollute environment and what negative influence its reach or could be reach in the future.

Considering above-stated, the court pass judgment about the refusal of ecological government inspection in satisfying claim in corpora.
